Please review the terms and conditions contained herein carefully. By clicking “I agree” or accessing and/or using the product (the “Product” or the “Explorer”) on the Website at https://devnet.routescan.io (the “Website”), provided by Routescan, You have read, understood, and accepted all of the following terms, as well as all of the terms which are incorporated herein by reference.
1. RIGHTS AND OBLIGATIONS
The following terms of use (the “Terms”) constitute a binding agreement between Routescan and the person, persons, or entity (“You” or “Your”) accessing and/or using the Explorer. The Explorer includes code licensed under third-party license agreements, including open source made available or provided with the software. By accessing and/or using the Explorer, You have read, understood, and accepted all of the following Terms and agree to be legally bound by these Terms, in their most recent version; You further represent and warrant that: You have the right, power and authority to enter into these Terms on behalf of such corporation, governmental organization or other legal entity and to legally bind it to these Terms.
Your access and/or use of the Product is contingent upon Your acceptance of these Terms.
Routescan may amend these Terms at any time. Amendments will be effective 24 (twentyfour) hours after the modified terms and conditions have been posted on the Website, except for amendments that relate to new features or made for legal reasons, which will become effective immediately. If You do not agree to such modified terms, You should discontinue Your use of the Product.
2. PRODUCT
The Product is a software that allows You to access data about blocks, transactions, addresses, network statistics and mempools related to different blockchains. By accessing the Website, You expressly relieve and release Routescan from any and all liability and/or loss arising from your use of the Product.
3. PRIMARY OBLIGATIONS AND WARRANTIES
By using the Product, You warrant that:
  • • You will only use the Product for Permitted Use.
  • • Except for the open source contents of the Website, You will not modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works in whole or in part with respect to the Product.
  • • You will not do anything to harm Routescan’s reputation including Routescan’s Products or Services. Including any representations about the Product provided.
  • • You will not use the Product to publish, disseminate, or otherwise make available any illegal content of any kind, including but not limited to content that is sexual, terroristic, racist, defamatory, harassing, abusive, or otherwise objectionable or unlawful.
  • • Any illegal content encountered through the use of the Product must be reported immediately using the specific form provided on the Website. Routescan will, to the possible extent, take appropriate action upon receiving such reports.
The Product is provided "as is," without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and non infringement. In no event shall the authors or copyright holders be liable for any claim, damages or other liability, whether in an action of contract, tort or otherwise, arising from, out of or in connection with the software or the use or other dealings in the software.
Any use of the Product in court proceedings in any jurisdiction, whether as evidence or otherwise, must be priorly authorized in writing by Routescan. Unauthorized use of the Product in legal proceedings is strictly prohibited and may result in termination of your access to the Product and further legal action.
4. COMPLIANCE AND ACCOUNT REGISTRATION
You must only access and use the Product for a bona fide and Lawful business use.
You shall in connection with the use of the Product comply with all legislation, regulations, and other rules having equivalent force which are applicable to that party, including the Privacy Laws and all other Laws, rules and regulations that relate to the privacy, protection, use or disclosure of Personal Information, and any subordinate or associated regulations.
You must comply with all Privacy Laws in relation to Personal Information.
By accessing the Website You have the chance to create an account (with Routescan) to access specific services (“Account”). When you create an Account, you agree to:
  • (a) provide accurate and truthful information;
  • (b) maintain and promptly update your Account information;
  • (c) maintain the security of your Account by protecting your credentials and restricting access to your computer and your Account;
  • (d) promptly notify us if you discover or otherwise suspect any security breaches related to your Account; and
  • (e) take responsibility for all activities that occur under your Account and accept all risks of any authorized or unauthorized access to your Account, to the maximum extent permitted by law.
5. SERVICE LIMITATIONS AND MODIFICATIONS
Routescan will make reasonable efforts to keep the Product operational. However, certain technical difficulties or maintenance may, from time to time, result in temporary interruptions.
To the extent permissible under applicable law, Routescan reserves the right, periodically and at any time, to modify or discontinue, temporarily or permanently, functions and features of the Product, with or without notice, without liability to You, for any interruption, modification, or discontinuation of the Services or any function or feature thereof.
6. INTELLECTUAL PROPERTY RIGHTS
You acknowledge and agree that, except for the open source contents, the Product is the property of Routescan or its licensors. Subject to Your compliance with these Terms, Routescan grants You a license access and/or use of the Product. The right to access and/or use the Product is a non-exclusive, non-transferable, revocable, limited license, and it is subject to the limitations and obligations contained herein. Nothing in these Terms gives You any license (other than as set out in this section), right, title, or ownership of, in, or to any of the Product.
You acknowledge and agree that Routescan retains all rights, title, and interest in and to all copyrights, trademarks, trade secrets, patents, and any other proprietary rights in the Product, the software and application programming interfaces (APIs) comprising the Product, and all content therein. You acknowledge and agree that Routescan, its trademark, service mark, logo and graphics are the registered trademarks or trademarks of Routescan.
All other trademarks, registered trademarks, product names and company names or logos mentioned through our Services are the property of their respective owners. Reference to any products, services, processes or other information, by name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation by Routescan.
Routescan may use other companies' name, logo, and related trademarks in any of Routescan's publicity or marketing materials (whether in printed or electronic form) for the purpose of highlighting that they use the Routescan Product and Services and alongside any testimonials that they have agreed to give. These companies grant Routescan such rights as are necessary to use its name, logo, related trademarks and testimonials for the purpose of this clause. If you provide any feedback, suggestions, or ideas regarding the Services ("Feedback"), you hereby assign to Routescan all rights, title, and interest in and to such Feedback. Routescan may use the Feedback for any purpose without any obligation to you.
7. TERMINATION
Routescan may terminate these Terms or suspend Your use to the product at any time, including, without limitation, in the event of Your alleged or actual misuse of the Product or breach of these Terms.
8. LIMITATION OF LIABILITY
In no event will Routescan, its officers, shareholders, employees, agents, directors, subsidiaries, affiliates, successors, assigns, suppliers, or licensors be liable for any loss or damages, including without limitation, direct, indirect, special, consequential, or punitive loss or damages, arising from or related to Your use of the Services, whether in an action of contract, tort or otherwise, and regardless of whether such damages were foreseeable and whether or not Routescan was advised of the possibility of such damages.
Without limiting the generality of the foregoing, Routescan takes no responsibility for and will not be liable for any financial or other loss or damages arising from or related to the use of the Routescan product.
The Product is integrated with third-party services. Routescan takes no responsibility for any third-party services and will not be liable for any loss or damages caused by such third-party services.
The Product is provided on an “as is” and “as available” basis without any representation or warranty of any kind, whether express or implied, to the maximum extent permitted by applicable laws. Routescan disclaims any implied warranties of title, merchantability, fitness for a particular purpose and/or non-infringement.
9. RESTRICTIONS
By accessing and/or using the Product, You acknowledge and agree that You shall not use the Product if applicable laws, based on Your country of location, residency and/or citizenship, prohibit You from doing so in accordance with these Terms.
By accessing and/or using the Product, You acknowledge and agree that You shall not use, or assist third parties to use, the Services in any way which may constitute a contravention of applicable laws or which may contradict the purposes or hinder the operations of the Product or hinder the operations of other users of the Product. Without limitation to the foregoing, You acknowledge and agree that You shall not use, or assist third parties to use the Product to, without limitation, avoid taxes, or engage in activities that may amount to market abuse (including, without limitation, front-running, wash trades, etc.), engage into illegal gambling, frauds, money laundering or terrorist activities.
Moreover, when accessing or using the Product, you must not:
  • (a) Use our Services in any manner that could interfere with, disrupt, negatively affect or inhibit other users from fully enjoying our Product, or that could damage, disable, overburden or impair the functioning of our Product in any manner;
  • (b) Use our Product to pay for, support or otherwise engage in any illegal activities, including, but not limited to illegal gambling, fraud, money-laundering, or terrorist activities;
  • (c) Use any robot, spider, crawler, scraper or other automated means or interface not provided by us to access our Services or to extract data;
  • (d) Engage in Automated Data Collection (scraping) unless such Automated Data Collection is confined solely to search indexing for display on the Internet;
  • (e) Engage in the reproduction of any content posted (such as public labels or name tags) or extracted from our APIs, CSV exports or our website or any of our affiliate websites without our prior consent or authorization.
  • (f) Use or attempt to use another user’s account without authorization;
  • (g) Attempt to circumvent any content filtering techniques we employ, or attempt to access any service or area of our Services that you are not authorized to access;
  • (h) Introduce to the Product any virus, trojan worms, logic bombs or other harmful material;
  • (i) Develop any third-party applications that interact with our Product without our prior written consent;
  • (j) Provide false, inaccurate, or misleading information; and
  • (k) Encourage or induce any third party to engage in any of the activities prohibited under this Section.
Users are strictly prohibited from accessing or using the Product if they are located in, under the control of, or a national or resident of any country designated by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC) as sanctioned countries. This includes, but is not limited to, the following countries: Iran, North Korea, Syria, Sudan, and Cuba.
Furthermore, users are prohibited from using our service if they are listed on any OFAC list of specially designated nationals and blocked persons, or any other restricted party lists maintained by the EU and US governments.
By accessing and using the Product, you represent and warrant that you are not located in, under the control of, or a national or resident of any such country or on any such list. If Routescan determines, in its sole discretion, that you have accessed the Website and used the Product in violation of this clause, Routescan reserves the right to terminate your access to the Website and the Product immediately and without notice.
10. INDEMNIFICATION
To the fullest extent permitted under applicable laws, You agree to hold harmless and indemnify Routescan, its officers, shareholders, employees, agents, directors, subsidiaries, affiliates, successors, assigns, suppliers, or licensors from and against all third-party claims and all liabilities, damages, assessments, losses, costs, or expenses (including reasonable attorney fees) resulting from or arising out of 
  • (i) Your alleged or actual breach of these Terms, including, without limitation, Your express representations and warranties; 
  • (ii) Your alleged or actual use or misuse of the Product; and 
  • (ii) Your alleged or actual infringement or violation of any laws or of the rights of a third party.
11. NO CLASS PROCEEDINGS
You will only be permitted to pursue claims against Routescan on an individual basis, not as a plaintiff or class member in any class or representative action or proceeding, and You will only be permitted to seek relief (including monetary, injunctive, and declaratory relief) on an individual basis.
12. USER GENERATED CONTENT AND THIRD-PARTY RIGHTS
You are solely responsible for the content of, and for any harm resulting from, any User-Generated Content that you post, upload, link to or otherwise make available via the Service, regardless of the form of that Content. Routescan is not responsible for any public display or misuse of your User-Generated Content. Routescan has the right (though not the obligation) to refuse or remove any User-Generated Content that, in its sole discretion, violates any Routescan terms or policies.
If you're posting anything you did not create yourself or do not own the rights to, you agree that you are responsible for any Content you post; that you will only submit Content that you have the right to post; and that you will fully comply with any third party licenses relating to Content you post.
Routescan needs the legal right to do things like host Your Content, publish it, and share it. You grant Routescan and its legal successors the right to store, parse, and display your content, and make incidental copies as necessary to render the Website and provide the service.
You retain all moral rights to Your Content that you upload, publish, or submit to any part of the Service, including the rights of integrity and attribution. However, you waive these rights and agree not to assert them against Routescan, to enable Routescan to reasonably exercise the rights granted in this Section 12.
o the extent this agreement is not enforceable by applicable law, you grant Routescan the rights we need to use your content without attribution and to make reasonable adaptations of your content as necessary to render the Website and provide the service.
Other than as expressly stated in the Agreement, a person who is not a party to this Agreement may not enforce any of its terms.
13. ENTIRE AGREEMENT‍
These Terms constitute all the terms and conditions agreed upon between You and Routescan and supersede any prior agreements in relation to the subject matter of these Terms, whether written or oral.
14. SEVERABILITY AND WAIVER
Unless as otherwise stated in these Terms, should any provision of these Terms be held totally or partially invalid or unenforceable, such invalidity or unenforceability shall not in any manner affect or render invalid or unenforceable the remaining provisions of these Terms, and the application of that provision shall be enforced to the extent permitted by applicable laws.
The failure of Routescan to exercise or enforce any of the rights or provisions of these Terms shall not be considered as a waiver of Routescan’s rights to do so.
15. ASSIGNMENT
Routescan may assign these Terms and/or delegate any of its obligations hereunder, in whole or in part. You may not assign these Terms or any part of them, nor transfer or sub-license Your rights under these Terms to any third party.r provisions of these Terms shall not be considered as a waiver of Routescan’s rights to do so.
16. NO PARTNERSHIP
Nothing contained in this Agreement shall be deemed or construed to create a principal and agent, partnership or joint venture relationship between You and Routescan.‍
17. FORCE MAJEURE
Routescan will not be deemed in default of these Terms to the extent that performance of its obligations is delayed or prevented by reason of any external force including, without limitation, war, insurrections, bank failures, telecommunications failure, Internet failure, strikes, fires, floods, earthquakes, labour disputes, epidemics, governmental regulations, freight embargoes, natural disaster, an act of government or any other cause beyond Routescan’s reasonable control.
